PLEASE READ THE FOLLOWING TERMS & CONDITIONS CAREFULLY

The following terms and conditions apply to all Grouptxt accounts. Go2mobile Solutions Ltd., hereinafter referred to as "Go2mobile", will provide service(s) to the account holder hereinafter referred to as “you” and “your”, in exchange for payment of fees and compliance with the terms and conditions of this document.

If you do not accept these Terms and Conditions you must not register for, or use the Grouptxt service.

You will use the service in a manner consistent with any and all applicable laws.

Indemnity
Go2mobile operates its service(s) subject to and in accordance with all applicable local, national and international laws. You agree to indemnify and hold Go2mobile and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this service.

All charges are payable upfront
You must pay all charges upfront by buying message credits. If you have no credits, you cannot use the service. Once you have paid the upfront charges, you will only be able to use the service after a reasonable time as we need to add the message credits to your account.

Expiry of message credits
You must use up your message credits within 180 days from the date you purchased the message credits.

New Account trial message credits
Go2mobile may offer free trial message credits to new account holders. We expect new account holders to use these trial message credits to test the functionality of our service(s) and messaging platform. We regard multiple registrations to make use of multiple free message credits as an abuse of our service. Accordingly, registration of more than 1 trial accounts, by a single account holder, is prohibited.

Message Credit usage
While we made every effort to deliver your text messages to the intended recipients, due to the nature of mobile telecommunications, we cannot guarantee delivery. Reasons for non delivery would include but not limited to:
  • network carrier restrictions on the recipients network
  • the intended recipient’s number may be invalid or unreachable.
A message credit will be deducted per recipient number that you send to, regardless of whether the message gets delivered to the intended recipient or not as we get charged for all attempted deliveries. It is extremely important that you do not share your password with family or friends as all messages sent via your account will be deemed as having been sent by you.

Cancelling a service
You may cancel a service at any time for any reason by following the procedure set out in these Terms and Conditions. When cancelling a service, the relevant provisions of these Terms and Conditions will apply.

If you wish to cancel a service please send an email to support@mail.go2mobile.com from your registered email address, with “Cancellation of Service” in the subject field.

Refund Policy/Cooling-Off Period
You can ask us to refund any unused credits within 7 days of purchasing those message credits.
When issuing a refund we will -
  • first deduct our charges for any messages sent;
  • keep 10% of the amount we refund you as an administration charge; and
  • keep any costs we incur to refund you (e.g. bank costs).
Other than as set out above, we do not issue refunds.

Your use of the Service
You must only use the service -
  • in accordance with these Terms and Conditions;
  • for lawful purposes;
  • in accordance with all applicable local, national and international laws and regulations;
  • for the purposes for which it are designed.
You hereby agree that any material transmitted through your account-
  • will not violate or infringe any copyright, trademark, patent, statutory, common law or proprietary rights of others, or contain anything libellous or harmful;
  • will not contain anything leading to an abusive or unethical use of the service. Abusive and unethical materials and uses include, but are not limited to, violations of privacy, computer viruses, and any harassing and harmful materials or uses;
  • will not be used to send junk text messages, spam or any unsolicited messages (commercial or otherwise);
  • will not be used for any potentially illegal activity;
  • Will not set out to inflict harm through bullying or intimidation;
  • Will not impersonate another individual (identity theft).
You hereby agree to indemnify and hold harmless Go2mobile from any claim resulting from any material transmitted through your account. Go2mobile may or may not give notice before deactivating an account which Go2mobile decides is being used for any of the above. Any unused message credits on your account will be confiscated.

Permission to send messages to contacts
It is the your sole responsibility to acquire necessary permission to send messages to your contacts. Depending on the contacts network tariff agreement they may be billed by their carrier to receive text messages. The Grouptxt service has a block list which allows you to enter one or more contact numbers that do not wish to receive text messages from you in future. Go2mobile is not responsible for the text messages sent by you.

Sender ID
The sender ID that can be included as part of a mobile text message is not a guaranteed feature. Your message might be sent without your sender ID and you will not be notified of this.

Breach
If you breach any of these Terms and Conditions, then we may immediately, without prejudice to our rights under these Terms and Conditions or otherwise at law -
  • stop or suspend your use of the service;
  • end the agreement; and/or
  • claim damages from you.
In all cases, we may keep all amounts already paid by you and recover all costs associated with your breach, as per these Terms and Conditions.

Please read our Privacy Policy carefully.

Copyright
All copyright, trademarks and all other intellectual property rights in the Go2mobile website and the Grouptxt portal and its content (including without limitation the design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Go2mobile or otherwise used by Go2mobile as permitted by law. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder.

Links to Third Party Websites
The Go2mobile website and the Grouptxt portal may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that Go2mobile are not responsible for the content or availability of any such sites.

Severance
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the law of the Republic of Ireland and you hereby submit to the exclusive jurisdiction of the Republic of Ireland courts.

Disclaimers and Limitation of Liability
The service is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. To the extent permitted by law, Go2mobile will not be liable for any direct, indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the service provided herein, including, but not limited to, losses or damages resulting from the loss of data as the result of delays, non-deliveries, or service(s) interruptions. Go2mobile makes no warranty that the functionality of the service will be uninterrupted or error free, that defects will be corrected or that the service or the server that makes it available are free of viruses or anything else which may be harmful or destructive. Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Go2mobile for death or personal injury as a result of the negligence of Go2mobile or that of its employees or agents.

Changes to Terms and Conditions
Go2mobile reserves the right to make changes to the Terms and Conditions of this Agreement including (without limitation) the charges at any time without notice to you.

Any changes will become effective when we publish them online. You must check the Terms and Conditions section regularly for changes.

Utilisation of the service by you following the effective date of such change shall constitute acceptance by you of such change(s).
